Your privacy is of utmost importance to us. At Trackfellow AB, (hereinafter “Trackfellow”), we are committed to respecting your privacy and adhering to all relevant laws and regulations regarding any personal data we may gather about you, whether through our app, Trackfellow, or its related services. The relevant laws and regulations include the General Data Protection Regulation, (EU) 2016/679 (GDPR), the Act with Supplementary Provisions to the GDPR (2018:218) and in addition, the Ordinance with Supplementary Provisions to the GDPR (2018:219). We respect your privacy and your right to control your personal data.

This policy (hereinafter “Privacy Policy”), is created to help you understand how Trackfellow collects, stores, uses, shares, and safeguards your personal information. We are also describing on what legal basis the processing is based and how long your data is kept. We also provide information regarding how you can exercise your rights in accordance with the applicable data protection legislation.

This Privacy Policy is addressed to:
- The private users of our application.
- The visitors of our website.

1. Data Controller

Trackfellow AB with org. number 559473-2785 is the data controller responsible for processing personal data in accordance with the applicable data protection legislation. You can find the contact details at the end of this Privacy Policy.

2. What is personal data?

Personal data refers to any information that can be used to identify you. This encompasses details about you personally (such as your name, address, and date of birth), information about your devices, payment information, and even data regarding how you use an app or online service.

3. How we process personal data, what personal data we process and the legal basis for the processing

The information we process and collect from you is automatically collected information. Automatically collected information pertains to any data automatically sent by your device when accessing our app and its related services. The processing of your personal data is further described below. 

3.1 Downloading the Trackfellow application

When using our application, we process personal data relating to you as a user. When downloading the application, we will collect data concerning the device that you are downloading the application on. Such information are technical data such as what device you are using and your IP-address. When you access our servers via our app, we may automatically log the standard data provided by your device. It may include your device's Internet Protocol (IP) address, your device type and version, your activity within the app, time and date, and other details about your usage. We also process:
- Device information (Device model, Operating system, Unique Device Identifiers, Screen resolution)
- Application information (App version, Build number)
- Error reporting data (Crash logs, Stack traces, Error messages, Error timestamps)
- Session data (User session time and interactions within the app, Navigation patterns and page views)
- Network information (Type of network, WiFi, mobile data, etc., Network provider)
- Location data (GPS coordinates, Rough location based on network data)

Legal basis: Our legitimate interest. Our legitimate interest of processing your data is that we need to collect your usage of the application to provide you services and the best version of our application to you.

3.2 Creating an account and using the application

To be able to use the application, you need to sign in with your Google or Apple Account. You thereby create a secure, passwordless account with Trackfellow. We will then process your e-mail address, name and profile picture.

Our application´s purpose is to collect and use information regarding your location, such as GPS data, accelerometer, timers, or your running route (including precise location data that shows your geographical position).

Such information may also be processed when you communicate with us through requests, questions or similar matters.

Legal basis: Entering into contract.

For us to be able to administrate and maintain our contractual relationship we process the personal data mentioned above in order to provide you with the best possible service and experience of our application. Depending on whether you use the free version or premium version of the app, we process your billing information.

3.3 Communicating with us

Contact us via e-mail, social media, or similar way through social media.

When you contact us for support or other customer service requests, including if we communicate with you via e-mail, chat, online, telephone or via social media, we will keep records of your requests, any complaints you may have or any other data that we receive it.

3.4 Behavioral data

For Trackfellow to be able to analyze the usage of our application and services we may also collect your electronic identification data (obtained by means of cookies, pixel tags, or similar technologies), including personal data about how you access, use and interact with our services.

Such personal data may include information such as your IP address, mobile device identifier, cookie ID, cookie content, browser type, browsing and click behavior and other activities, purchase information, domain name, referrer-URL, access dates and times, hardware and software information, information about the device you use (e.g., device ID, device type), operating system, and approximate location.

Legal basis: Our legitimate interest. Our legitimate interest of processing your behavioral data is that we need to collect your usage of the application in order to improve our services and provide the best version of our application to you.

3.5 Customer Surveys

To improve our service to our customers, we may send out a customer satisfaction survey or ask you to rate our application. We may ask you for your view on using the application and what improvements that can be made.

Legal basis: Our legitimate interest. Our legitimate interest of processing personal data in customer satisfaction surveys is that we need to collect your opinions to improve our services and provide the best version of our application to you and other customers. The categories of personal data processed for this purpose are contact details and communication data.

3.6 Recruitment

When you apply for a job, we process your personal data to assess your application, conduct interviews, contact references and possibly hire you. The categories of personal data processed are contact details, personal identification number and other information that you or your references provide us with. The personal identification number is processed to ensure a proper identification of you. The references that we contact will be informed of our processing of their personal data.

Legal basis: Entering into contracts.

If you do not submit the personal data that we need you may not be able to enter an employment contract with us.

3.7 Legal documentation requirement 

We may need to process your personal data to comply with rules regarding bookkeeping and audits. The category of personal data processed for this purpose is contact details.

3.8 Cookies

We process the information created by the cookies set when you visit our application and website such as the length of your visit, the number of page views, the choices you make, and how you found it. See separate cookie policy on our website.

4. Retention of data

We retain your personal information only for as long as necessary for the purposes outlined in this Privacy Policy. For example, if you have provided personal information when creating an account, we may keep this information for the duration of your account's existence on our system. If your personal information is no longer required for this purpose, we will delete it, or anonymize it by removing all identifying details.

However, we may retain your personal information if it is necessary for compliance with legal, accounting, or reporting obligations, or for archiving purposes in the public interest, scientific or historical research purposes, or statistical purposes. Please see specific examples here below.

4.1 Legal documentation requirements

We store the personal data relating to legal requirements regarding bookkeeping and audits, for up to seven years after the expiry of the calendar year during which the financial year ended.

4.2 Customer surveys

We store the personal data relating to customer surveys for a maximum of 12 months. 

4.3 Contact with customer support

When contacting our customer support, we keep the customer support for a maximum of two weeks after the case is closed.

4.4 Recruitment

We store the personal data for 30 months after the recruitment process has been finalized to be able to respond to any legal challenges.

5. Security of personal data

When we collect and process personal information, and while we retain this information, we will protect it using commercially acceptable means to prevent loss, theft, unauthorized access, disclosure, copying, use, or modification.

Although we strive to protect the personal information you provide, we acknowledge that no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute data security.

6. Disclosure of Personal Information to Third Parties

Should our app include links to third-party websites and services, please note that these external sites and services have their own privacy policies. When you click on a link to any third-party content, it is important to review their privacy policy to understand how they collect and use personal data. Our Privacy Policy does not cover any actions you take after leaving our app or website.

6.1 We may share personal information with the following entities:

- Third-party service providers to enable them to deliver their services, including (but not limited to) IT service providers, data storage, hosting and server providers, error loggers, debt collectors, maintenance or problem-solving providers, marketing providers, professional advisors, and payment system operators.
- Employees, contractors, and related entities.
- Current or prospective business partners.
- Credit reporting agencies, courts, tribunals, and regulatory authorities if you fail to pay for services we have provided to you.
- Courts, tribunals, regulatory authorities, and law enforcement officers as required by law, in connection with any actual or potential legal proceedings, or to establish, exercise, or defend our legal rights.
- Third parties, including agents or sub-contractors, who may assist us in providing information, products, services, or direct marketing to you.
- Third parties for data collection and processing.

We do not share any data to any countries outside of the EU/EEA.

7. Rights as a Data Subject

7.1 Right of access

As a data subject, you have the right to receive information regarding the personal data that we process about you (register extract). For us to provide you with the information most relevant to you, it is advisable, but not a formal requirement, to specifically state the personal data that you are interested in.

7.2 Right to rectification

It is our responsibility to ensure that the personal data we process are correct and relevant. We therefore systematically maintain our registers and update address details and similar information about you so that we always have the correct information. If you notice that the information we have about you is incorrect, or if we are missing important information, you have the right to have your data corrected.

7.3 Right to erasure

You have the right to request that we erase your personal data in certain situations. For example, if the personal data no longer are necessary for the purpose for which they were collected and processed. Such right also exists If we process personal data based on your consent and you withdraw it, if the personal data have been processed in an unlawful way or if we process the data based on a balance of interest (legitimate interest) and there is no overriding legitimate basis that outweigh your interest.

7.4 Right to data portability

You have the right to request the transfer of your personal data to another party if our processing is based on the legal bases consent or contract, and the processing is carried out by automated means.

7.5 Right to object

You have the right to object against our processing of any personal data that we process based on our legitimate interests. Please specify the processing that you are objecting to, in writing. In the event of an objection, we may only continue processing your personal data if we can demonstrate compelling legitimate basis for processing the personal data that outweigh your interests. However, we may still process your personal data to establish, exercise or defend legal claims.

7.6 Right to restriction of processing

In some cases, you have the right to demand that our processing of your personal data should be restricted. If the processing is restricted, we will only have a right to process your personal data for the purpose of establish, claim or defend legal claims or to protect someone else’s right.

The right to demand restriction applies if you believe that the personal data is incorrect and have requested rectification. Restriction of personal data also applies if you have demanded that your personal data should be erased since you have objected to a processing based on the lawful basis legitimate interest, pending the verification whether our legitimate basis override your legitimate basis. Lastly, you may request restriction if we do not need the data any longer for the purpose of the processing, but you need the data to be able to establish or claim or defend legal claim.

7.7 Right to withdraw consent

If we ever base our processing of your personal data on the legal basis consent, you always have the right, at any time, to withdraw that consent.
